Conditions of Contract of Maldivian Airline

  1. As used in this contract “ticket” means this passenger ticket and baggage check, or this itinerary/receipt if applicable. In the case of an electronic ticket, of which these conditions and the notices form part, “carriage” is equivalent to “transportation”, “carrier” means all air carriers that carry or undertake to carry the passenger or his baggage hereunder or perform any other service incidental to such air carriage, “electronic ticket” means the itinerary/Receipt issued by or on behalf of Carrier, the Electronic Coupons and if applicable, a boarding document, “Warsaw Convention” means the Convention for the Unification of Certain Rules Relating to International Carriage by Air signed at Warsaw, 12th October 1929, or that Convention as amended at The Hague, 28th September 1955, whichever may be applicable, “Montreal Convention” means the Convention for the Unification of Certain Rules for International Carriage by Air signed at Montreal, 28th May 1999, “Tokyo Convention” means the Convention on offences and Certain Other Acts Committed on Board Aircraft, 4th December 1969.
  2. Carriage hereunder is subject to the rules and limitations relating to liability established either by the Warsaw Convention or the Montreal Convention unless such carriage is not “international carriage” as defined by that Convention.
  3. To the extent not in conflict with the foregoing carriage and other services performed by each carrier are subject to: (I) provisions contained in the ticket; (ii) applicable tariffs; (iii) carrier’s conditions of carriage and related regulations which are made part hereof (and are available on application at the offices of carrier), except in transportation between a place inside United States or Canada and any place outside thereof to which tariffs in those countries apply.
  4. Carrier’s name may be abbreviated in the ticket, the full name and its abbreviation being set forth in Carrier’s tariffs. Conditions of carriage, regulations or timetables; carrier’s address shall be the airport of departure shown opposite the first abbreviation of carrier’s name In the ticket; the agreed stopping places are those places set forth in this ticket or as shown in carriers timetables as scheduled stopping places on the passenger’s route: carriage to be performed hereunder by several successive carriers is regarded as a single operation.
  5. An air carrier issuing a ticket for carriage over the lines of another air carrier does so only as its Agent.
  6. Any exclusion or limitation of carrier shall apply to and be for the benefit of agents’ servants and representatives of carrier and any person whose aircraft is used by carrier for carriage and its agents, servants and representatives.
  7. Checked baggage will be delivered to bearer of the baggage check. In case of damage to or missing/delayed baggage, the incident must be reported to Maldivian or Ground Handling Agent staff before leaving the Arrival Terminal. All claims related to damaged, missing/delayed baggage should be addressed to Maldivian Baggage Services in writing, within a period of 7 days. Refer to Maldivian Baggage Policy for details.
  8. This ticket is valid for carriage for one year from date of issue, except as otherwise provided in the ticket, in carrier’s tariffs, conditions of carriage, or related regulations. The fare for carriage hereunder is subject to change prior to commencement of carriage. Carrier may refuse transportation if the applicable fare has not been paid.
  9. Carrier undertakes to use its best efforts to carry the passenger and baggage with reasonable dispatch. Times shown in timetables or elsewhere are not guaranteed from no part of this contract. Carrier may without notice substitute alternate carriers or aircraft and may alter or omit stopping places shown on the ticket in case of necessity. Schedules are subject to change without notice. Carrier assumes no responsibility for making connections.
  10. Passenger shall comply with Government travel requirements, present exit, entry and other required document and arrive at airport by time fixed by carrier or if no time is fixed, early enough to complete departure procedures.
  11. No agent, servant or representative of carrier has authority to alter, modify or waive any provision of this contract.
  12. Right to refuse carriage
    1. The air carrier may refuse to carry you and/or your baggage for a limited period of time for the following reasons:
    2. You and/or your baggage put the aircraft’s or passenger’s safety at risk or danger.
    3. You have caused damage to aircraft or removed properties from aircraft
    4. You have not paid any applicable fares, charges, and/or fines levied on you by the air carrier.
    5. You are a risk/ danger to other passengers or the aircraft.
    6. You have threatened or caused harm and/or injury to the crewmembers, staffs and/or other passengers.
    7. You have committed a criminal offence inside the airport of departure.
    8. You have made a bomb threat against the air carrier.
    9. Your behavior is threatening or abusive towards the crewmembers, staffs and/or other passengers.
    10. Your mental and/or physical state or conduct may put other passengers at risk or danger.
    11. You are suspected and/or under the influence of alcohol and/or drugs.
  13. Conduct on board the Aircraft and in the Airport.
    1. In accordance with Article 1 (c), Chapter V of the Maldivian Civil Aviation Regulations (2015), the pilot-in-command of the aircraft is responsible for the operation and safety of the aircraft, the safety of the crewmembers and passengers on board the aircraft. All passengers are reminded that everyone on board must obey the lawful commands of the pilot-in-command and crew members. All crew members are authorized to give orders to resolve the issue of disruptive and unruly passengers, as best as they can.

      2. Where the air carrier files a claim in the courts against you for violating the above terms and conditions, you must pay to the air carrier all costs arising in connection with such claims.
      3. Kindly note that all aircrafts operated by the air-carrier are non-smoking aircrafts. Smoking is strictly forbidden. If you are found smoking on board the aircraft, the air carrier may file the case against you at the Police and/or relevant authorities for investigation and to forward the case to Prosecutor General’s Office to prosecute you for the offence and/or the air carrier may levy a fine and the offender shall be liable for any damages/losses incurred.
      4. If you conduct yourself on board the aircraft or at the airport of departure in a way that endangers the aircraft, its crew, ground staff and/ or other passengers, or obstruct the crew members and/or ground staff in the performance of their duties, or do not comply with the instructions by the crew members or ground staff, or behave in an unruly, unsafe or aggressive manner to which other passengers may reasonably object; the pilot in command may direct the crew to restrain or remove you from the aircraft. The air carrier retains the right to file the case against you at the Police and/or relevant authorities for investigation and the concerned authority may forward the case to Prosecutor General’s Office to prosecute you for any offences conducted on board the aircraft.
